“Hard cases make bad laws”
Whatever one thinks of Gawker, its demise is a footnote next to the precedent it set in muzzling investigative journalism that discomfits the powerful.
Haha, "investigative journalism that discomfits the powerful" doesn't include publishing a sex tape that was taken without a person's knowledge. Gawker got what was coming to it.
Here's a thought experiment: if it was Chyna who was secretly recorded having sex and had that published in 2012, would you be so dismissive of it?
Gawker got shutdown because they called Peter Theil gay. The rest is just window-dressing.
No, Gawker got shut down because they were awful people with no ethics, and eventually went too far. Peter Thiel funded the lawsuit to shut them down because they said he was gay. No side is the good side here.
One side is slightly better
^ This is the answer.
I don't remember if they published the ACTUAL sex tape and I assume I would have intentionally refused to look then like I do now.
Posting non-consensual media of sexual activity is wrong, full stop.
Posting the AUDIO of that? yeah, if Joanie were dropping n-bombs and being hateful I would be all for a tabloid rag to ruin her (already pretty ruined by WWE and Paul "HH Helmsely" Levesque) life over that.
They didn't publish all of it, Wikipedia said they only published 10 seconds. But that's enough.
