Now this is truly a shit post. It looks shit and reeks of shit made by a shitty American I assume.

You know your constitutional given right of free speech, yes? Yeah but that doesn't entail being free of consequences. Or as the cool kids say: fuck around and find out.

Defamation of public figures has to have consequences especially when they are so god damn shallow as calling Ricarda Lang in 2024 a fattie.

You also don't go to jail over this. But the Platform Provider Gab not cooperating with law enforcement is the real scandal here.

[–] FelixCress@lemmy.world 2 points 2 weeks ago (1 children)

You know your constitutional given right of free speech, yes? Yeah but that doesn't entail being free of consequences

USians somehow tend to think their constitution applies worldwide πŸ˜‚

[–] SecretiveSailor@lemmy.world -2 points 2 weeks ago* (last edited 2 weeks ago) (2 children)

Yeah freedom of speech SHOULD apply worldwide. Is that really an insane thing to say?

[–] Bo7a@piefed.ca 1 points 2 weeks ago

Yes. Any other stupid questions?

[–] FelixCress@lemmy.world 1 points 2 weeks ago (1 children)

Freedom of speech is not and should not be unconditional. It does not cover spreading hate or lies.

[–] SecretiveSailor@lemmy.world -1 points 2 weeks ago (1 children)

Spreading of lies is called defamation. And that's illegal everywhere.

[–] FelixCress@lemmy.world 2 points 2 weeks ago

Yeah? Say it to Trump.

[–] remotelove@lemmy.ca 0 points 2 weeks ago (1 children)

I don't give a shit about this post or any argument happening, but I am curious about why you think defamation of public figures specifically, has to have consequences?

I am not a fan of defamation against anyone, but I give the least amount of fucks for any politician. (Maybe one or maybe half of a fuck is given in their case.)

[–] DmMacniel@feddit.org 0 points 2 weeks ago (1 children)

I think that people don't have to take shit from bullies and we have laws to help victims in this regard.

[–] SecretiveSailor@lemmy.world -2 points 1 week ago

She's the bully. The user who made that comment is the victim. Its one thing to call someone fat, its a totally different thing to throw them in a prison cell.

If she wants justice, just reply to that comment and call the commenter a fatass too. There problem solved!

[–] SecretiveSailor@lemmy.world -3 points 2 weeks ago* (last edited 2 weeks ago) (2 children)

Lmao GAB is an American platform. They have no obligation to cooperate with Neo-Nazis from Germany ordering them to turn over personal information to imprison an innocent internet user. In fact GAB did the right thing by protecting that person.

Calling a politician fat is not "defamation". Are you high, friend?

[–] DmMacniel@feddit.org 2 points 2 weeks ago (1 children)

Ah yes of course, we all are just neo-nazis here in Germany.

Sod off arsehole and go back to actual fascist USA.

[–] SecretiveSailor@lemmy.world -2 points 2 weeks ago (1 children)

The nazis engaged in propaganda and punished people who spoke ill against their politicians. This is Nazi behavior. And since we're in modern times, they are "Neo Nazis". Neo means "new".

[–] DmMacniel@feddit.org 2 points 1 week ago* (last edited 1 week ago) (1 children)

Yeah no, Nazism has a meaning and this ain't it. Especially when you believe that free speech comes with free of consequences. Not even the US constitution says so.

[–] SecretiveSailor@lemmy.world -2 points 1 week ago* (last edited 1 week ago) (1 children)

Wtf does that mean? "free speech" literally means the ability to air ideas without the threat of violence or persecution. So yes, free speech should come without any legal consequence.

[–] DmMacniel@feddit.org 1 points 1 week ago (1 children)

Wrong. Free speech means that nobody denies you your right to speak and or censoring you. Also that only applies to Congress, that they don't deny you those. And those amendments only apply in your country as other nations have different laws.

Here is the actual text, see if there is any word of freedom of consequences:

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

[–] SecretiveSailor@lemmy.world -2 points 1 week ago* (last edited 1 week ago) (1 children)

Threatening to throw someone in jail if they insult a politician IS a restriction of free speech. How else do you restrict free speech? They can't install blocking devices inside a person's vocal chords that prevents the speech from even occuring.

This is like saying speeding is not restricted because people can still push the pedal beyond the speed limit. Of course they can! But there are state enforced consequences for it, which means that speeding is illegal (restricted).

[–] DmMacniel@feddit.org 1 points 1 week ago

Oh well, I tried and failed, there is no reason to continue trying to argue with you about this.

But here is a solution: if a provider can't deal with laws and jurisdiction of other nations, they should make their platform restricted to their respective nation (geofencing, id verification).

[–] denaggels@feddit.org 1 points 2 weeks ago (1 children)

Who are the Neo-Nazis in Germany again? You don't seem to be an expert or even an informed individual on this issue. Not even in the slightest.

[–] SecretiveSailor@lemmy.world -2 points 2 weeks ago (1 children)

People threatening to imprison members of the public just because they insulted one of their politicians. That definitely sounds like Nazi behavior to me.

[–] denaggels@feddit.org 1 points 1 week ago

Since you still haven't presented a credible source, I highly doubt that it's just because someone called her fat. Usually that comes along with threats and that is punishable.

[–] Denjin@feddit.uk 2 points 2 weeks ago (1 children)

Gab is a cesspool, can't find what was actually said but the request states "sexualized and denigrated" so we can assume it went beyond calling her fat.

This was also more than a year ago so nice try, turns out the actual fascists are still the fascists.

[–] SecretiveSailor@lemmy.world -3 points 2 weeks ago (1 children)

They just added "sexualized and denigrated" to make it sound more important. In the original comment, it was just calling her fat. Plus even if the comment sexualized and denigrated, is that a reason to take someone's basic freedom away and throw them in a prison cell?

[–] Denjin@feddit.uk 1 points 2 weeks ago (1 children)

Do you have a copy of the original post? If so, share it, otherwise you're just saying words with no evidence.

[–] SecretiveSailor@lemmy.world -2 points 2 weeks ago (1 children)
[–] Denjin@feddit.uk 2 points 2 weeks ago (1 children)

Once again, that doesn't contain the words actually used in the original post. It's just regurgitating the same thing.

Post the original comment or your point is not valid.

[–] SecretiveSailor@lemmy.world -2 points 2 weeks ago* (last edited 2 weeks ago) (2 children)

The news article paraphrases the original comment (which is probably now deleted)

[–] Denjin@feddit.uk 2 points 2 weeks ago

Also I've just read that page and it doesn't paraphrase anything.

[–] Denjin@feddit.uk 2 points 2 weeks ago

Fox News paraphrasing doesn't mean anything.

[–] Treczoks@lemmy.world 2 points 1 week ago (1 children)

First, the BKA is no GeStaPo like the American ICE. It's more like the FBI, but more professional.

On the other hand, this is a normal request for identification of a potential defendent in a criminal case. They have reason to assume the person is German, and public diffamation (not only of politicians, this applies to anyone) is a crime.

[–] SecretiveSailor@lemmy.world -2 points 1 week ago* (last edited 1 week ago) (2 children)

If they want to arrest someone for calling a politician fat, They are WORSE THAN ICE! That's not professional at all. A professional does not get deterred by random internet comments calling them fat.

And I don't care what the laws are in Germany. They can make how many ever useless ass laws they want, doesn't change what is morally right/wrong.

[–] orygin@piefed.social 2 points 1 week ago (1 children)

Go back to your third world country and stfu about countries you know nothing about, even less about its laws and constitution.
Either stay within the confines of your knowledge, or shut up and listen to what others are trying to make you understand.
Don't wonder why Americans are seen so negativity abroad, you are part of the problem.

[–] SecretiveSailor@lemmy.world -2 points 1 week ago (2 children)

The founding fathers studied the laws and constitution of other countries all too well and knew exactly what NOT to do and warned against fuhrious fatties. Everybody says America sucks but are still fighting to get here (legally or illegally). Cause it sucks so much!

[–] munsking@lemmy.world 2 points 1 week ago

people aten't even going on holidays in your shithole anymore bud.

nobody wants to live in your turd reich

[–] orygin@piefed.social 1 points 1 week ago* (last edited 1 week ago)

I'm not fighting to get to the USA. It's a radioactive hell hole, just look at tourism stats and see it nosedived since the orange turd was voted in.
Btw, I would be really surprised if your founding fathers read Germany's constitution before making their own...

[–] Treczoks@lemmy.world 1 points 1 week ago

If they want to arrest someone for calling a politician fat

If it had been only that, this would not have happened. The BKA is a very professional police force. So there must have been way more. And this has nothing to do with her being a politician (except maybe for the reasons of the perpetrator).

And I don’t care what the laws are in Germany.

But it is the law here. This is not America. And that is good, looking at what is happening there. Which could not happen here.

They can make how many ever useless ass laws they want, doesn’t change what is morally right/wrong.

What you might think to be morally right or wrong. The world is not America. Thank goodness for that.

The first sentence of the German "Grundgesetz" (Constitution) is "Die WΓΌrde des Menschen ist unantastbar": Human dignity is inviolable. Think about it.

[–] remon@ani.social 1 points 2 weeks ago (1 children)

Ah yes, that's certainly some text. Do you have the rest of the pixels so one can actually read it?

[–] SecretiveSailor@lemmy.world -1 points 2 weeks ago (1 children)
[–] FelixCress@lemmy.world 2 points 2 weeks ago (1 children)

... And any RELIABLE source?

[–] SecretiveSailor@lemmy.world -2 points 2 weeks ago (3 children)

Fox News is a reliable source. They're not some fringe alternative news outlet.

[–] BleatingZombie@lemmy.world 1 points 1 week ago

They argued in court that they're not news. You should take their word for it

[–] Thoven@lemdro.id 1 points 1 week ago

Fox "news" themselves claim to be an entertainment program, not a legitimate source of news
