That's one way to get out of owning one. Just claim the brake gave out and it rolled into the water. As many mechanical issues those things have it will be hard for the insurance company to argue otherwise. Insurance check incoming to buy a non nazimobile.

Can an insurance company demand the surveillance video or would that be private since the driver has an expectation of privacy?

Yes. Expectations of privacy wouldn't be relevant in this context, you should expect the insurance company to want all of the available data from the car before they pay out.

I mean, that's a solid way out of it.

Insurance can request surveillance tape but they have no authority to demand or get it unless provided willingly. It would have to be provided by the property owner. They do also offer to pay for the tape if they feel it will show what they need.

Tesla probably has something I'm the fine print that has a clause that gives insurance owners cars video.
