This pisses me off. It also makes me want to get a burner phone for that very purpose.

But I am worried that if I go over the border with a burner phone I might get suspected of something and arrested. How likely is that?

Don't visit the United States. They've already demonstrated they're willing to send legal immigrants to prison in El Salvador on unproven accusations, and Trump is on record stating he wants to send US citizens there. There's minimal oversight or accountability for their border/ICE agents; even if visitors bring their passports everywhere, ICE could easily detain them, "lose" their passport, and claim they don't have one and entered illegally.

The United States is an unfriendly nation.

Yeah, it's like trying to visit North Korea, Russia or Iran, just don't. You can't trust the leadership in any of those countries.
