The weird thing is that it looks like the 5 judge panel couldn't agree on how to handle it, but somehow an opinion that 2 out of the five judges agreed on turned out winning. And that opinion didn't actually vacate the fraud conviction, just the penalty. "He did the bad thing, but since they asked for too high a fee now he pays nothing". Its so confusing....
